Relatives Mutually Conceal Their Misconduct.
法律允许一定范围内的亲属隐匿或包庇犯罪而不负刑事责任。“亲亲相隐”至少可追溯至春秋战国时期。汉代时,被正式确立为法律原则,此后历朝历代皆依循。2012年修订后的《中华人民共和国刑事诉讼法》解除了被告人父母、配偶、子女强制出庭作证的义务。此举被学界视为“亲亲相隐”思想的当代体现。
The law permits relatives of a criminal to conceal or harbor his/her crime and to be exempt from criminal responsibility to a certain degree. The concept can be traced back to at least the Spring and Autumn and the Warring States periods. It was formally established as a legal principle in the Han Dynasty, and followed by successive dynasties since then. TheCriminal Procedural Law of the People's Republic of Chinarevised in 2012 exempted a defendant's parents, spouse and children from the obligation to testify against him/her in court. The exemption is regarded in academic circles as a contemporary embodiment of this concept.
