浅谈商务英语的翻译

摘要：在我们所了解 的对外经贸的交易中，国际贸易的合同是整个商业活动的必经环节，商务合同的中文还有英文翻译文本，起到了很大的作用。整个商务合同的特征就是他们所需要表达的对象，而且对于商务合同的翻译流程还有翻译的原则都需要经过细致的描述，还可以对如何才能进一步的提高商务合同的翻译质量问题作出了较为具体的解决方法。

我们所了解的商务合同是来自于各个方面之间为了他们自己的权利还有各自的义务，在商务合作的进行之中，还有依法制定的，需要经过公证的需要双方共同遵守的条文。在英译商务合同和协议时，须对其上述三项，特别是后两项特征需特别留意，否则就会失之毫厘，谬以千里，给当事的一方或双方造成不可挽回的损失。

一、商务合同文本特征概述

（一）使用公文的语言的时候，需要我们语句短小精炼，文章的构思严谨缜密

公文语副词是由副词here、there、where等分别加上after、by、in、of、on、to、under、upon、with等副词，构成的复合公文语副词。如：hereafter，thereafter，thereon，thereupon，hereinafter等。

例1.本合同自买方和建造方签署之日生效：This Contract shall come into force from the date of execution hereof by the Buyer and the Builder.例2.兹特由双方授权的代表，和上面的日期还有签署的合同作为合同依据。IN WITNESS WHEREOF the panties hereto have executed this Contract by their authorized representatives as of the date first above written.

（二）良好准确的使用商务合同它是一种特殊的应用文体，用词语或者文章的特点都是准确还有严谨的

英语翻译合同的时候，就会造成选词的不恰当还有意思的不确定或者词汇错误。例1双方需要遵守合同。/双方遵守合同的规定：Both parties shall abide by the contractual stipulations./All the activities of both parties shall comply with the contractual stipulations.

英语中abide by与comply with均意味“遵守”。Both parties agree to change the time of shipment to August and change US dollar intoHong Kong dollar.翻译时需注意 change A to B与 change A into B的差异。前者意指“把A改为B”，后者意为“把A折合成/兑换成B”。

（三）句子为了保证商务合同还有翻译的准确，不会引起误会，商务合同还有协议的英文翻译句子通常都是较为繁杂的

例1. The Customer and NEXPRESS each agree and undertake that during the Term and Thereafter it will keep confidential and will not use for its own purposes or without the prior written consent of the other party disclose to any third party any part or all information concerning the terms of this Agreement unless such information is in the public domain other than as a result of a breach of this clause.

例2. If no written objection is raised by either party one month before its expiry，this Agreement will be automatically extended for another year.在期满前一个月，如果双方未用书面提出异议，本协议将自动延长一年。商务合同及协议中常用的连接词有：if，in case that，in the event that，unless等。

例3. Should one of the parties fail to comply with the terms and conditions of this Agreement，he other party is entitled to terminate this Agreement.如果一方未按本协议条款执行，另一方有权中止协议。should可放在句首引出倒装条件句。

例4.It is agreed that a margin of 2 percent shall be allowed for over or short count.双方同意，允许的误差为正负2%。it作形式主语。例如：从此以后、今后：hereafter；此后；后：thereafter；thereon/thereupon；在其下：thereunder；对于这个：hereto；对于那个：whereto；在上文：hereinabove/hereinbefore；在下文：hereinafter/hereinbelow；在上文中、在上一部分中：thereinbefore；現用两个实例，说明在英译合同中如何酌情使用上述副词。

例 1：这个合同在签署日期后生效。This Contract shall come into force from the date of execution hereof by the Buyer and the Builder.

例 2：以下的签署者同意在中国生产商品。The undersigned hereby agrees that the new products whereto this trade name is more appropriate are made in China.shipping advice 与 shipping instructions

另外要注意区分 vendor（卖主）与 vendee（买主），consignor（发货人）与 consignee（收货人）。

abide by 與 comply with.Both parties Shall abide by/All the activities of both parties shall comply with the contractual stipulations.

change A to B 与 change A into B；英译“把 A 改为 B”用“change A to B”，英译“把 A 折合成/兑换成 B”用“change A into B”，两者不可混淆。

The last batch per/ex/by S.S.“Victoria” will arrive at London on October （S.S. = Steamship）The good shall be shipped per M.V.“Dong Feng” on November 10 and are due to arrive at Rottedaml in 140 days. （M.V.= motor vessel）on/upon 与 after （BR） （BR） 当英译.“…到后，就…时，用介词 on/upon，而不用 after，因为 after 表示“之后”的时间不明确。

发货的钱需要到付。

（BR） The invoice value is to be paid on/upon arrival of the goods. by 与 before当英译终止时间时，比如“在某月某日之前”，如果包括所写日期时，就用介词 by；如果不包括所写日期，即指到所写日期的前一天为止，就要用介词 before。

二、关键地方重视处理

我们在实践中发现，英语合同翻译的时候经常会出现一些个差错，不是陈述性条款有错误。而是一些关键的地方例如：时间，金钱，数量。为了避免出现失误，应该详细认真的写出文章的大小写还有语句。

例 ：聘方须每月付给受聘方美元 500 元整。Party A shall pay Party B a monthly salary of US $ 500 （SAY FIVE HUNDRED US DOLLARS ONLY）.

总结，我们国家的不断进步之中，有着很多的存在的漏洞与问题，商务合同的签订时每天必不可少的，因此对于我们合同的翻译也有很大的要求，作为一个翻译人员应该了解合同的特点，掌握合同所需要的准则，才会很好的完成工作任务，为社会发展做贡献。
