民间交流是中美友好关系的重要基石

中国共产党第十九次全国代表大会于2017年10月胜利闭幕。这是一次意义非凡的大会,会上宣布中国特色社会主义进入了新时代,为我们描绘了中国未来发展的宏伟蓝图,并指出中国社会的主要矛盾已经转化为人民日益增长的美好生活需要和不平衡不充分的发展之间的矛盾。换言之,人民希望过上更美好的生活。中国的目标是到2020年消除绝对贫困,到2049年建成社会主义现代化国家。为了实现这些目标,我们需要进一步深化经济体制改革,缩小城乡差距,鼓励开拓创新,改善生态环境。更重要的是,我们要坚持对外开放。正如习近平总书记所言:“中国开放的大门永远不会关闭,只会越开越大。”中国将为美国提供更开放的市场,也欢迎世界各地的朋友到中国旅游、学习和工作。中国的开放度与日俱增,我们所要做的便是抓住此机,时不我待。

中国为未来的发展明确了长远的目标,它的实现需要一个稳定、有利的外部环境,尤其需要与像美国这样的世界大国建立稳定、持续、平衡的双边关系。中美关系是最重要的双边关系,对世界有着举足轻重的意义。中方高度重视中美关系的发展。2017年11月,美国总统特朗普对中国进行了国事访问,这是特朗普总统就任以来首次访华。中国以“国事访问+”的规格接待了特朗普总统,习近平夫妇陪同特朗普夫妇参观故宫博物院,并安排家庭晚宴。在为期两天的访问中,两国元首会晤超过10个小时,双方进行了富有成果的会谈,对双边关系产生了积极影响。在两国元首的共同见证下,中美签订了涵盖能源、飞机、芯片、大豆等商品在内的共计2535亿美元的经贸合作订单。习近平和特朗普还回顾了自2016年4月首次会晤后确立的四个高级别对话机制的进展情况,内容包括外交安全对话、全面经济对话、执法及网络安全对话、社会和人文对话。双方还进一步探索中美潜在的合作领域。不可否认,中美之间还存在诸多分歧,但是双方都意识到妥善处理分歧的重要性。应有之举便是保持当下政府和民间在对话与交流上的良好态势。

People-to-people Exchanges are Important for Sino-US Friendly Relations

China has just concluded the 19thParty Congress in October.This is a significant event for the country, as the Congress announced china’s development has entered a new era. A blueprint has been made for future growth, with a view to addressing imbalanced and inadequate development and meeting the economic, political cultural, social, and ecological needs of our people. In other words, we want to offer the people a better life. Our vision is to eliminate extreme poverty by 2020 and develop China into a great modern nation by 2049.To make these goals into reality, we will in the coming years deepen economic reform, reduce social disparity, encourage innovation, improve environment and above all, continue our opening-up to the outside world. As President Xi Jinping said,“China’s door to the world will never close, but will only open wider.”We will offer more market access to US companies and welcome more international friends to travel, study and work in China. Openness grows everyday: what we need to do is to seize the day and seize opportunities.

As China has set a long-term goal for development, it requires a stable and favorable external environment to carry out that goal. In particular, we need to build a stable, sustained and balanced relationship with major countries such as the United States. China-US relationship is the most defining bilateral relationship in the world. The Chinese side places a high premium on growing our bilateral ties. Last month, President Trump paid his fi rst state visit to China. He was given a “state visit plus” reception, as President Xi Jinping personally gave him a special tour of Forbidden City and arranged for him a family dinner. In the two day’s visit, the two presidents spent more than 10 hours together, which yielded fruitful discussion and positive outcomes. They witnessed, among other things,the signing of business contracts worth of $253 billion, rang-ing from energy deals to the purchase of US airplanes, chipsets and soybeans. They also reviewed the progress of the four dialogues initiated in their first meeting last April, covering diplomacy and security, economy and trade. law enforcement and cyber security as well as on people-to-people exchanges.All of them have had the fi rst round of dialogues this year and have delivered concrete bene fi ts for the two peoples. The two sides are still exploring potentials for cooperation. Of course there are some areas in our relations where we do not always see eye to eye, but both sides recognize the importance of properly managing our differences. The right approach to that is to keep momentum of dialogues and exchanges, both on national and sub-nation levels.

If we look back at china-us relations, our state-to-state ties just began with people-to-people exchanges. 50 years ago, it is the Ping Pong Diplomacy that drove normalization of China-US relations. Stephen, you were deeply involved in that process and you should be very proud of that. On this people-topeople exchange, the Association for International Exchange of Personnel has also played a positive role in fostering subnational ties between our two countries. Over the last 30 years,you have maintained deep engagements with a host of US educational institutions, industrial associations and famous scholars, made great efforts in arranging academic visits and offered good services to foreign experts working in China.This has greatly substantiated our people-to-people ties, as we see many foreign experts have come to China-some even spent most of their life time there-and helped China in many ways to transform to a modern and prosperous society. These efforts form the fundamental part of our state-to-state ties, and help to build an even closer relationship between the two countries.

回望中美关系,官方层面的交往正是源于民间的友好交流。50年前,“乒乓外交”拉开了中美关系正常化的序幕。以促进两国人民民心相通为基础,中国国际人才交流协会在促进中美民间关系上发挥了积极作用。过去的30年里,协会保持了与美方教育机构、企业协会和知名学者的深度合作,为推进学术访问、外国学者来华工作作出了重要贡献。这些努力维系了中美之间人文交流的纽带。我们欣喜地看到越来越多的外国专家来华工作,有些专家甚至大部分时间都在中国工作,帮助中国向现代化大国迈进。中国国际人才交流协会的努力为政府层面的互动提供了坚实的基础,极大地拉近了中美两国之间的关系。(译/张怡晟)

从人才接收端到建立平等国际对话:中国拥有独到经验

很荣幸,2010年我获得中国政府友谊奖。这个奖是颁给那些为中国经济社会发展作出突出贡献的外国专家。我与中国国际人才交流协会的合作可以追溯到2002年,但我至今也不敢说自己有多大的贡献。不过,我觉得很幸运,能将自己的职业生涯与中国的经济发展紧密结合在一起。我相信所有的友谊奖获奖者都非常喜欢在中国生活,哪怕理由各不相同。众所周知,中国人在学习的道路上始终保持着认真好奇的态度,并怀揣着强烈的求知欲。“学而时习之,不亦说乎?”中国人礼贤下士,用自己的勤勉践行孔子在《论语》中的主张。除了业务成就外,我们有幸领略中国山河的壮美和文化的灿烂。

我们都有一个感同身受的体验,那便是当代中国自下而上、由内而外的变化,用“翻天覆地”来形容也不为过。比如,中国的大门——北京首都国际机场,它的变化是中国腾飞的一个缩影。在早年,国外飞机抵达北京是降落在T1航站楼;到了20世纪九十年代,我们可以降落在T2航站楼;为了迎接2008年北京奥运会,北京首都国际机场修建了T3航站楼,而T3航站楼的规模比T1和T2两个航站楼加起来还要大。如今,北京正计划建设另一个新的国际机场。无论是世界史还是中国史,这种迅猛发展的情况都是非常罕见的。现在我们正处于这样一个数百年难遇的时代里,我非常荣幸能见证这场巨变。

China Has Lots of Unique Experience Which Is Worth to Share

It’s my honor that I am one of the 2010 Friendship Award recipients. The award is presented to “foreign experts who have made outstanding contributions to China’s economic and social progress”. While I have worked closely with CAIEP since 2002, I am not sure if I have made outstanding contributions. I have been,however, lucky enough to have spent a lot of my professional career in close contact with the Chinese economy.

I believe all the Award recipients have enjoyed their experiences in China for a multitude of reasons. It is generally agreed that Chinese people approach learning with a serious attitude and obvious curiosity, with a strong desire to absorb new knowledge.They work diligently, following the wise words of Confucius in the Analects - “Is it not pleasant to learn with a constant perseverance and application?” They learn with respect and appreciation toward the more knowledgeable ones. Apart from serious business exchange, we were exposed to beautiful landscapes of China, and an abundance of historical artifacts and relics.

A very precious experience shared by us is that we worked with China during a time when China was undergoing a downsideup inside-out turn-around. Calling such a change earth-shaking is not an exaggeration. The gate of China, the Beijing airport,is perhaps the most iconic and obvious example of the explosive progress. In the early days, we would land at Terminal 1 of the Beijing airport; in the late 1990s, we would land at Terminal 2.Then in the mid-2000s, in preparation for the 2008 Beijing Olympics, Terminal 3 was opened, bigger than Terminal 1 and 2 combined. Flash forward to the present day, ten years later, Beijing is building a new second international airport, completely separated from the existing location. When one looks into history, either World history or Chinese history, such rapid ascension is rare. I’m very privileged to witness the change.

On a personal level, I found a place where I was able to share my experience and my expertise with people who valued and appreciated our support. I was able to observe the rapid change from the frontlines and feel as if I had grown with this country.Along the way, I have been fortunate to have CAIEP (China Association for International Exchange of Personnel) as a partner and as a friend; they have been a key driver to providing a vehicle for dialogue.

I guess, in the past, China was probably more on the receiving end of personnel exchange conducted by CAIEP. Over time,however, China’s experts have acquired some unique experience that can be shared with outside, such as experiences in civil engineering. When we say technology, the US is no doubt in the leading position. However, China has ingeniously developed a special set of knowledge in dealing with all kinds of terrains and managing construction. Let me give you an example of the latter - managing construction. You can watch a video clip on Youtube, where Chinese construction workers replaced the Sanyuan Bridge in Beijing within 43 hours. Sanyuang Bridge, as you may know, is on Beijing’s 3rd ring over the highway to the airport, one of the busiest sections in Beijing. Minimizing interruption of traf fi c is always a blessing to the general public and city business. Such an experience of expediting bridge refitting is an excellent example to share with other big cities in the States, such as Los Angeles or Atlanta. Following the example,we should, more than ever before, pursue a mutually bene fi cial and open dialogue.

Secondly, since the economic reform and opening in the 70s,China has achieved huge economic success. However, it is still a developing country with tremendous challenges ahead. The former Premier Wen Jiabao said no matter how small a problem is, when you multiply it by a population of 1.3 billion, the problem becomes colossal; no matter how big the size of an economy is, when you divide it by the population, the fortune turns trivial. I am an engineering technologist in the chemical industry, which is considered very much matured in technology. But, I can tell that there is still much room to improve. For China the needs seem to emerge in such areas as environmental protection, safety, engineering management just to name a few.In summary, I hope the CAIEP will broaden its attention by expanding into non-economy, non-production arenas with a sense of promoting a more harmonious society.

The General Secretary Xi Jinping in the press conference after the fi rst plenary session of the 19th Communist Party Central Committee said “We should never entertain the idea of taking a breather or halting our steps”. Along this direction, CAIEP will continue to play a crucial role for the next 30 years.

My CAIEP friends - you have my support and the support of countless friends outside China who will make themselves available when you need their assistance. We can work together to create a better future.

中国是一个值得我分享经验、发挥所长的地方。中国人也非常重视并且感激我们的帮助。我在一线见证中国的巨变,与这个国家一起成长。一路走来,我幸运地结识了在中国国际人才交流协会工作的伙伴和朋友。该协会一直是推动中国对外交往的中坚力量,致力于打造一个国际对话交流平台。他们让我们感受中国人的热情好客。

过去的中国更多的是处于人才交换的接收端。时过境迁,中国的专家现在拥有许多值得与外界分享的独到经验,如在土木工程方面的经验。当我们提到科技,美国无疑处于领先地位。然而,中国巧妙地在地形勘测和建筑管理上自成一派。以建筑管理为例,大家可以在YouTube上观看一段关于北京三元桥43小时完成改造的视频。三元桥位于北京三环路东北角拐弯处,横跨在机场高速公路上,该桥所处的位置是北京最繁忙的地段之一,最大限度地减少施工对交通的干扰是市民和商贸经营者的共同心声。这种桥梁快速改造的经验是非常有价值的,是值得洛杉矶、亚特兰大等美国大城市学习的。因此,相比以往,我们外国专家更应该寻求一种互利和开放的对话。

自20世纪70年代改革开放以来,中国取得了举世瞩目的经济成就。然而,中国仍然面临着诸多挑战,它依旧是一个发展中国家。前任总理温家宝曾说:不管多么小的问题,只要乘以13亿,那就是很大很大的问题;不管多么可观的财力,只要除以13亿,那就成为很低很低的人均水平。我是一名化工领域的工程技术专家,在技术上被认为是非常成熟的,但是我觉得还有很大的提升空间。对于中国而言,这意味着要在环境保护、城市安全、工程管理等方面实现突破。为了建设一个更和谐的社会,我希望中国国际人才交流协会能扩大对非经济、非生产领域的关注。

习近平总书记在第十九届中央政治局常委同中外记者见面会上说:“我们不允许产生任何喘口气、歇歇脚的念头。”按照习总书记的要求,中国国际人才交流协会必将在未来的30年发挥更大的作用。

我会永远支持中国,无数海外朋友也会鼎力相助。让我们一同创造更美好的未来。(译/张怡晟)

搭起中美法学教育交流的一座桥梁

美国天普大学法学院前院长、2003年度中国友谊奖获得者

30年来,国家外国专家局为促进中美两国关系作出了卓越贡献,极大地加强了这两个伟大的民族在教育和研究方面的相互交流。

天普大学非常荣幸能够成为这种历史性的发展与交流中的一分子。1979年,天普大学荣幸地为邓小平先生授予荣誉法学博士学位。从那时起,我们就积极地展开与中国的合作。天普大学和国家外国专家局的合作由来已久,特别是在法学教育方面,取得了令人瞩目的成果。在中国国家外国专家局的支持下,天普大学已与中国的许多大学和政府单位建立了良好的关系,包括全国人民代表大会、最高人民法院和最高人民检察院。

我本人有幸与国家外国专家局合作多年,也结识了很多外专局的朋友。我们之间的深入交流与国家外国专家局的大力支持是密不可分的。我们与外专局的三任局长都有过合作,他们都非常支持我们的工作。我十分欣赏万学远局长的睿智、季允石局长的幽默和张建国局长的热忱。2003年,张建国局长计划到天普大学做一年的访问学者,我非常高兴地答应并准备好了正式的邀请函。然而就在他动身之前,他因升职而推迟了来访计划。虽然,我们失去了一位好的访问学者,但国家外国专家局却迎来了又一任优秀的局长。天普大学非常珍惜与国家外国专家局的长期合作关系。双方合作的历史自1997年开始,最有代表意义的合作项目是清华大学与天普大学合作举办的“清华—天普美国法学硕士教育项目”。该项目首开中美法律教育交流的先河,同时得到中国教育部和美国律师协会(ABA—美国法律教育认证机构)的承认,已成为在中国本土取得美国法学学位证书的历史最长的项目。

天普大学法学院为最高人民法院、最高人民检察院和中华全国律师协会的法律工作者提供非学位的短期教育合作项目,也为研究中美法学的大学法学教授们提供学术交流和课程开发的机会。清华—天普法学硕士项目积极在中国举办各类经验交流会和学术研讨会,先后在北京和青岛成功举办了法学教育经验交流会,在西宁举办了公正刑事程序学术与实践研讨会,在北京和昆明举办了卫生法讨论会。天普大学法学院的国际法和公共政策研究中心定期举办各项学术型圆桌会议,至今已成功举办了以WTO合规讨论、网络法规、环境法规与政策、国际私法以及健康法规与政策等法律问题为主题的圆桌会议,在各个领域都获得了实实在在的成果,并在中美两国的法律研究方面发表和出版了许多文章和著作。在国家外国专家局的指导和建议下,天普大学法学院和中国国内七所大学结成合作伙伴关系,实现了深度的学术交流。天普大学法学院向这些合作院校的教师们提供赴美进修的机会,接受学生们到天普大学法学院交换学习,同时这些合作院校也成为天普学生到中国的留学基地。

Building a Bridge between China and US in Law Education

SAFEA’s dedicated work in New York, which now extends for three decades, has significantly contributed to the positive relationship of the United States and China, and the vast growth of the mutual exchanges in education and research between our two great nations.

Temple is proud to be part of efforts in promoting this development and growth. In 1979, Temple had the honor of awarding an Honorary Doctor of Law Degree on Deng Xiaoping. Since then,we have been actively engaged in cooperation with China. Temple and SAFEA have a long history of collaboration, particularly in the area of legal education. With SAFEA’s support, Temple has established strong relationships with many Chinese universities and government entities, including the National People’s Congress,Supreme People’s Court and Supreme People’s Procuratorates.

I have had the privilege working with SAFEA for many years and have so many friends in SAFEA. Our mutually bene fi cial exchanges with China could not have occurred without the tremendous support that SAFEA provided. We have worked with three SAFEA ministers, all of whom have been extraordinarily supportive. Thinking about each, I particularly value Minister Wan Xueyuan’s wisdom, Minister Ji Yunshi’ humor and Minister Zhang Jianguo’s enthusiasm. In 2003, Minister Wan asked me to accept Mr. Zhang Jianguo as a visiting fellow at Temple for a year, and I happily signed the invitation letter. Shortly before his departure for Temple, Mr. Zhang Jianguo was promoted and thus had to postpone his visit. We lost the chance to have a wonderful visiting fellow, but SAFEA got a chance to have a great minister.

Temple treasures our relationship with SAFEA. The most important of our partnership is the rule of law initiatives, which we began together in 1997. The centerpiece of these initiatives is the Temple-Tsinghua Master of Laws program in Beijing. This program is the fi rst program to be accredited by both the Chinese Ministry of Education and the American Bar Association to offer a foreign law degree in China, and it remains the only one that offers in-country American law degrees in China.

In collaboration with SAFEA, Temple has offered non-degree legal education for judges in cooperation with the Supreme People’s Court, for prosecutors with the Supreme People’s Procuratorate, and for lawyers with the All China Lawyers Association.Temple has also supported scholarly research by American and Chinese law professors and curriculum development for Chinese law schools in developing areas of law. Past workshops include an Experiential Legal Education Course Materials Workshop in Beijing and Qingdao, Fair Criminal Trial Workshop in Xining, and Health Law conference in Beijing and Kunming.

Temple’s Institute for International Law and Public Policy has hosted month-long roundtables on WTO Compliance, Law of the Internet, Environmental Law and Policy, Private International Law, and Health Care Regulation. All roundtables and workshops have produced concrete results, including articles and books published in the United States and China. Finally, Temple partners with seven Chinese law schools for academic exchange,providing Chinese faculty with resources to conduct research at Temple and students with opportunities to study abroad at Temple as part of their legal studies in China. These programs have all been conducted with SAFEA’s support and guidance.

To date, 1,511 legal professionals have participated in our ruleof-law initiatives, including 390 judges, 173 prosecutors, 142 government officials, and 170 law professors. This number includes the graduates and students in our Temple-Tsinghua Master of Laws program, which now total 726.

These results could not have occurred without the SAFEA’s support and guidance. Each year, Temple law school’s leadership visits SAFEA in Beijing, and each visit for us is like a return home. We truly delight in our partnership and look forward to continuing to working together to reach our common goals. I am sure that our partnership with SAFEA will continue - and will continue to grow. You can count on our continued support.

迄今为止,在法学教育这一重点合作领域,天普大学法学院已为中国培养了1511名国际法律专业人才,其中包括390 名法官、173名检察官、142名政府官员和170名执业律师。其中有726人是从清华—天普法学合作项目取得了美国法学硕士学位(包括在读生)。

如此丰硕的成果离不开国家外国专家局的支持和指导。每年秋季,天普大学如期访问国家外国专家局,每一次访问都如同老友再会一样倍感亲切。我们十分欣慰能有这样长期的合作伙伴,天普大学法学院将一如既往地支持和配合国家外国专家局的工作。让我们放眼未来,为了我们共同的目标携手共进,祝愿外专局不断创造辉煌的成就。
