The Abatement of Violence: The Sublimation of Humanity in the Process of Civilization——Stephen Pinker’s View of History and Ethics

Gao Like

(College of Media and International Culture, Zhejiang University, Hangzhou 310058)

(4)

Abstract:According to Stephen Pinker, the evolution of human history presents a process of reducing violence, which is the most important thing in human history, representing the process of “the better angels of human nature”overcoming “the demons”.The decline in violence is the result of “the pacification of State”,“the process of civilization”,“the humanitarian revolution”,“the long period of peace” since the Second World War, and the “new peace”, the“ revolution of rights” resulting from the moderation of arms conflicts.Pinker’s low-key historical view of violence decline as the scale of progress and his low-key moral view of“reducing suffering”, though lacking exciting and desirable idealism, embody the great humane spirit of modern “civilization”.In the final analysis, civilization is a process of human sublimation from barbarism. The utmost importance of the decline in violence to human history is on account of the value of life and human dignity. This great humanitarian victory is the proudest achievement in the progress of human civilization.

Abstract:Regional financial stability is the foundation of macro-financial stability. The fluctuation of regional financial risks and their governance will directly affect the stability of the macro-financial system.Based on the provincial-level intermediate frequency data from 2015 to 2019, this paper selects 14 basic indicators from eight major risk areas to synthesize the financial stability index of 31 provinces in China with quarterly frequency, depicting the important risk characteristics that cause the heterogeneity of financial stability and development of each province, and revealing the risk factors behind it.This study finds that from 2015 to 2019, China’s overall financial stability operation is not optimistic.Significant spatial heterogeneity can be found in the financial stability operation of different provinces and regions, and the main financial risks that stand out in different periods are also different. The study concluded that promoting the appropriate concentration of regional financial resources, guiding regional finance to match the development level of the real economy, and strengthening the management and control of prominent risks in stages are the three longterm measures that can be implemented in regional financial risk management.

Feng Lvbing1, Guo Dongjie2

(1.Business School, Hangzhou City University, Hangzhou 310015; 2.School of Economics, Zhejiang University of Technology, Hangzhou 310023)

(25)

Abstract:Increasing farmers’ income is the key to achieving public prosperity.Based on the theoretical analysis of income growth, this paper uses the micro-survey data of CFPS to conduct 2SLS estimation, and finds that Internet use significantly promotes the increase of individual income of rural residents. At the same time, through the method of core explanatory variable lag estimation and subsample regression, it is proved that the reverse causal effect of income on the Internet does not threaten the reliability of the conclusion.Further heterogeneity analysis shows that: Internet use has a significant positive impact on the income increase of rural male and female residents, but has no significant effect on the income increase of rural residents aged 65 and above; the longer the years of education, the more income increase rural residents can gain through Internet infrastructure. The mechanism test found that “information access channel” is an important way for the Internet to increase the income of most rural residents. To a certain extent, the research conclusions support the importance of developing rural information infrastructure and increasing the Internet penetration rate in rural areas to increase the income of rural residents and narrow the income gap between urban and rural residents.

Key words:Internet use; information infrastructure construction; income of rural residents; urban-rural income gap

(Law School, China University of Political Science and Law, Beijing 100088)

(36)

Abstract:In the face of the great challenges of the information society, the legal protection of personal information needs to determine the basic feature of personal information right. However, the justification of personal information rights is controversial in theory. The nature of information and the moral significance of rights are two theoretical problems that need to be solved in justifying personal information right.Information is an interpretive concept, and the technical, value and social dimensions exhibited by personal information, supported by highly sophisticated information technology, are the basis for demonstrating the importance of information.Justifying the right to personal information still needs to return to the value framework of the debate between the free will thesis and the interest thesis.Factors like the collision of technical rationality and the values in the information society, the transformation of the way individuals interact with society, and the transformation of personal personality to digital personality, entail the justification of personal information right more difficult. The conception of right based on the common good is capable to respond to the legal challenges of the information society, and advocates that personal information right lies in the dual contribution to individual interest and the common good of society. To a large extent, the defense of personal information right is to establish ethical norms and civilized rules for the development of the information society, and the design of legal systems for the protection of personal information should also reflect the value logos of common good.

Key words:information; personal information right; interest thesis; common good

Equality before the Law: Before Whom? Which Equality?

Luo Yizhong

(Faculty of Law, Shanghai Normal University, Shanghai 200234)

(46)

Abstract:Equality before the law is treated as a foundational legal principle, but its range and force remain unclear. To specify this principle as “treat like cases alike” would still cause the doubt of redundancy. The kind of equality intrinsic to law conceptually depends on the generality of rules. And since the range of this principle is confined to the application of law, it cannot guarantee the law’s content being equal, nor does it amount to fully justified decisions. However, the principle of equality is realized in legal institutions by abstraction, and the normative force of such a formal principle cannot be replaced by any substantive principle of equality.

Key words:treat like cases alike; formal equality; substantive equality; abstraction

Yu Linwei, Han Chen, Jin Jieke, Yu haiyan

(School of Public Health and Management, Wenzhou Medical University, Wenzhou 325035)

(64)

Abstract:Based on the theory of livelihood capital, this paper uses the 2017 National Health and Family Planning Dynamic Monitoring Survey of the Migrant Population to analyses the influence of livelihood capital on migrant workers’ intentions of settlement and Hukou transfer through a binary logistic regression model with five dimensions: natural capital, physical capital, human capital, financial capital and social capital. The commonality between the two influencing factors is mainly reflected in the economic dimension of the situation, and the differences are reflected in aspects such as the drive of migrant workers’ own longterm interests. The role of financial capital and human capital is reflected in the fact that migrant workers who are better off and better educated have a greater willingness to stay and settle in the city.As an important manifestation of social capital, the effective guarantee of urban public services and the accumulation of social capital will enhance migrant workers’ intentions of settlement. As an important component of natural and physical capital, the livelihood security function of contracted land and home bases in the old country can make migrant workers feel at ease to work and live in the city, but is not conducive to their settlement in the city.On this basis, this paper proposes to safeguard the natural capital of migrant workers to facilitate their settlement in the city, enhance their physical capital to achieve a secure livelihood, improve their human capital to enhance their urban survival ability, and improve their social capital to facilitate their psychosocial integration in the inflow area.

Philosophical Analysis of Intellectual Property Rights:A Case of Marx Accusing Lassalle’s Works of Infringement

Zhang Wenxi

(School of Philosophy, Renmin University of China, Beijing 100080)

(84)

Abstract:Contemporary intellectual property rights face many challenges. From the replacement of the focus of law to the starting point of philosophical analysis, there are still some outstanding problems to be clarified. It is a key problem how to justify the intellectual property as a right.Marx’s philosophy asks this question from a thought called knowledge creation, human freedom and reality. In the field of copyright,Marx has repeatedly accused Lassalle of plagiarism. As a simple judgment of fact, it is largely correct. However, Mehring, Bakunin and others introduced the misunderstood theory of mutual consciousness of subjects in the understanding of intellectual property rights from their own theoretical standpoint, and made a seemingly more fair interpretation of the case. They mistakenly regard the so-called imitator as the original creator of the right to work, and as the so-called people who are worthy of the parallel with Marx.In essence, this reflects a history of the international workers’ party movement engaged in ideological struggle with each other.

Between What Is Deserved and What Is Needed:A Rethinking of the Principles of Distributive Justice

Wang Chi

(School of Marxism, Northwestern Polytechnical University, Xi’an 710072)

(102)

Abstract:Distributive justice embodies the fairness or justice of human beings in distributing social good, and the key to the realization of distributive justice lies in the establishment of the principle of rational distributive justice. In the early days of human society, in the state of general material scarcity, on-demand distribution was widely applied as the most primitive and acceptable distribution principle, and after the rise of capitalism, economic relations became the most important relationship between people, and determining entitlements according to economic contributions became the general law of distribution.Although this distribution according to the due distribution of factors of production has achieved superficial justice, it is not just in terms of the results of distribution, and polarization is the biggest symptom, behind which is the debasement of the subjectivity of human beings and the neglect of human needs. For today’s China, it is necessary to organically combine distribution according to work and distribution according to needs under the framework of sharing, and promote the institutionalization of the establishment of the principle of mixed distributive justice under shared demands, so as to promote the comprehensive development of human freedom and social progress.

Key words:distributive justice; deserving allocation; allocation on demand; sharing

The Value Orientation of Yangming’s Mind-heart Theory

Yang Guorong

(School of Philosophy, Northwest Normal University, Lanzhou 730070)

(108)

Abstract:The concept of mind-heart theory not only embodies the unique philosophical approach, but also shows its value orientation. The concept of innate conscience as the core of mind-heart theory, in the sense of values, innate conscience inherently contains human concern or benevolent care, which is different from the value orientation of people as objects or tools.Another important proposition of mind-heart theory is“xin(mind)is li(principle)”.One of its meanings is the unity between individual consciousness and universal norms or principles. The value behind this unity is manifested in the double affirmation of individual rights and group responsibilities. The combination of the meaning concern implied by the mind as the body and the sense of responsibility implied by the innate conscience further leads to the feelings of the world. In Wang Yangming’s view, the feelings of the world are specifically expressed as the concept of the unity of all things, which contains the intention to go out of the closed self and treat others in a benevolent way.The sense of concern implied by “mind”, the sense of responsibility implied by “innate conscience”, and the feelings of the world involved in “unity of all things” are also faced with specific implementation problems. In Wang Yangming’s mind-heart study, this issue is related to the relationship between “knowing” and “doing”,which means that the real world or the meaningful world is based on human participation and construction activities, while real participation is also reflected in the actual process of doing things.

Key words:value orientation; innate conscience; xin(mind)is li((principle); everything is one

Interlity and Aesthetics:An Inquiry into the Interlity of Immersive Art Production

Tuo Jianqing, Miao Wenyu

(School of Humanities and Social Science,Xi’an Jiaotong University, Xi’an 710049)

(113)

Abstract:Unlike media fusion in the general sense, the production of immersive art makes use of any old and new media that can shape immersion to achieve “pan-media fusion”, and its cross-media narrative approach also helps to build a decentralized production model and transform the linear path of “communication-reception” into a state where “people are media and media are people”.Its cross-media narrative approach also helps to build a decentralized production model and transform the linear path of “communicationreception” into an indistinguishable state of “people as media and media as people”.The open meaningful space of the “immersion field” encourages the viewer to participate in it in an embodied way, giving life to the work through the body and forming a unity of technique, body and mind.Immersive art uses the viewer’s acceptance and creative understanding as the root of the meaning of the text, and this experience of selfhood not only fits the “possibility over reality”quality of immersive art,but also helps the viewer construct the power of his or her own spiritual world. For this reason, immersive art makes new changes in the relationship between medium and human, body and work, and text and viewer, starting from the issue of “interlity” and trying to get out of the “technology-only” and “art-only” dilemmas popular in the development of contemporary art. From the issue of “interlity”, he seeks to break out of the “technology-only” and “art-only” dilemmas prevalent in the development of contemporary art and re-examine the development and aesthetic transformation of future art.

Key words:Immersive art; Intermediality; Inter-subjectivity; Soma; Horizon fusion

Wei Lina

(School of Foreign Languages, Huzhou University, Huzhou 313000)

(123)

Abstract:The generation of literary classics is the choice of the times and the precipitation of history, governed by aesthetic standards and theoretical interests, which appeared as the relevant mechanism and process of Canonization, De/Anti-canonization, and Re-canonization.Adhering to the standpoint of sociology knowledge, with the power struggle of top-bottom hedging, cultural studies, cross-cultural studies, cultural anthropology, feminism, post-colonialism, and other theoretical schools, have destroyed the cultural Solidification constructed by modernism, breached the separatist regime in the area of knowledge and the hierarchy in the field of thought, and made public the hidden rules generated by traditional classics——the seemingly solemn and bitter classics of all ages are a kind of historical collusion. The reconstruction of literary classics that keep emerging in the times not only embodies the struggle for cultural power and the game of the literary field but also brings about the expansion of the ideological horizon and the construction of a new consensus of civilization.Female criticism, which arose after World War II and is still prevalent today, has brought about the discovery of gender politics and the civilizational renewal of gender balance, and the literary classics are saturated with the energy of ideas and civilizational worries in their historical drift and power transfer.

Key words:literary canonization; cultural power transfer; new consensus of civilization; gender politics; female criticism
