Abstract:According to the authorization of the national legislature, the Supreme Court has begun the pilot reform of the functional orientation of the four level courts since August 2021. As the top level of the court system, the Supreme People’s court’s own functional orientation is particularly important. From the perspective of the objectives of the pilot reform, the Supreme People’s court will further strengthen abstract guidance in terms of the functional orientation of trial guidance. For example, by strengthening the formulation of judicial interpretation norms, abstract trial guidance will be realized. This approach will weaken the judicial function of the Supreme People’s Court and its exemplary guiding function. Therefore, its function orientation should focus on the judicial function, and play its role of trial guidance through specific judicial acts. Although the formulation of judicial interpretation norms is still very important at the present stage, attention should be paid to grasping the boundary between judicature and legislation, theoretical research and theoretical transformation, and the boundary of application. The Supreme People’s Court, through its own specific trial demonstration, can be more vivid, concrete interpretation of the correct application of the law ideas and methods, trial practice on the issue of targeted guidance.The Supreme People’s Court is not only the most important translator of the theoretical results of legal research, but also the highest verifier of the theoretical application in the trial practice of the courts at all levels.

Abstract:Science and technology are the first productive forces, while innovation infrastructure is a important productive force of science and technology. Under the background of the new scientific and technological revolution and the outbreak of industrial transformation, the global technological progress has accelerated, and China itself has entered a new stage of development that must rely on innovation to drive economic development and industrial upgrading. Building the world’s leading new innovation infrastructure is of great significance for pushing China’s scientific and technological level closer to the forefront of the world, building an innovative country and achieving high-quality economic development. The new innovation infrastructure is a complex system, and public resources should be focused on major scientific installations, super-scientific projects and scarce verification platforms, so as to build the core body of innovation infrastructure. The “new” of the new innovation infrastructure should be embodied in four aspects: The first is to shoulder a new mission and consolidate the basic conditions for my country to become the world’s leading innovative country; the second is to expand into new areas, focusing on meeting the innovation needs of important enabling technologies and future technologies; the third is to create new carriers and effectively open up channels for production, education and research; the fourth is to apply new models to promote the participation of the private economy in the construction and operation of major innovation infrastructure.
