“我们对中国市场充满信心”专访乐高集团中国及亚太地区法务负责人罗灿 (Robin Lynne Smith)

案情回顾：上海警方侦破侵犯“乐高”玩具品牌著作权案

2019年4月23日，上海警方在广东汕头、深圳等地警方的配合下，成功摧毁了涉嫌侵犯“乐高”品牌著作权的犯罪团伙——“乐拼”，抓获以李某为首的4名犯罪嫌疑人，捣毁生产、包装、仓储等窝点3处，流水线10余条，缴获生产模具90余块，说明书近20万份，包装盒20万余件，成品“乐拼”玩具63万余件，涉案金额逾2亿元。

“乐拼”以营利为目的，未经“乐高”授权擅自予以复制、生产，违法所得数额巨大，已经涉嫌刑事犯罪。目前，该案李某、余某、杜某、闫某等4名犯罪嫌疑人已被依法刑事拘留，案件仍在进一步侦办中。上海警方成功破获此案，充分彰显了公安机关打击侵犯知识产权犯罪的信心和决心，有力地维护了企业的知识产权和智力成果。

加强知识产权保护 阻止侵权

《法人》：今年4月，上海警方侦破侵犯“乐高”玩具品牌著作权案，摧毁了山寨品牌“乐拼”生产和销售假冒“乐高”的犯罪链条，严厉打击了“乐拼”盗版侵权的违法犯罪行为。关于这个案子，您能分享下感受吗？

Faren Magazine:In April of this year，Shanghai police had spared no efforts to fight against infringing products constantly. In April， they took actions to stop“LEPIN” from counterfeiting and pirating “LEGO”， to stem “LEPIN”in intellectual property theft. Could you please share more details with us regarding this case?

罗灿：知识产权是乐高集团业务发展的重要基石，因此，我们不遗余力地在中国及全球其他地区加强对乐高商标、版权、设计及专利的保护。对乐高集团而言，确保消费者不会被误导是非常重要的。消费者购买的乐高产品都符合严格的安全和质量标准，这是他们可以并且期望从我们的产品中获得的。

在知识产权保护中，我们的另一个关注重点是阻止侵权者进行剽窃。我们欢迎公平竞争，但当有人滥用我们的IP时，我们会坚决采取一切必要的法律手段，以保护消费者权益以及我们的品牌权益。

举个例子，我们已经赢得了针对两个侵权案山寨品牌“Bela”和“乐拼”的诉讼，法院根据《中华人民共和国著作权法》和《中华人民共和国反不正当竞争法》对案件作出了公正判决。同时，我们也为上海警方在对“乐拼”工厂和仓库的突击检查行动提供了有力支持。

Robin Lynne Smith:Intellectual Property rights and assets are fundamental to the LEGO Group business， and we therefore constantly strive to enforce and protect our LEGO trademarks， copyrights，designs and patents， in China as well as abroad. Among others， we always make sure we keep a strong trademark portfolio and prioritize brand protection to ensure that our consumers are not misled. It's critically important to us that when our consumers buy a LEGO® set， they get a product of impeccable quality that lives up to the strictest safety standards， which is exactly what they can and should expect from our products.

Another focus area in our IPR protection is to stop copycat infringers who make blatant copies of LEGO products. We welcome fair competition at any time， but when someone misuses our IP， our brand and the consumer's trust，wetake what everlegal action necessary to protect consumers and our rights in our brand. For example，we have been litigating against two major copycat brands Bela and Lepin and received favorable decisions from Chinese Courts under copyright law and anti-unfair competition law. We also supported the Shang hai police on a massive raid action against the factory and warehouses of Lepin infringers.

对中国市场充满信心

《法人》：10月23日，中国国务院正式公布了《优化营商环境条例》，条例明确了为各类市场主体投资兴业营造稳定、公平、透明、可预期的营商环境的准则。您对中国当前的营商环境和市场前景，有哪些看法？

Faren Magazine:On October 23rd， the State Council has made public a regulation for the purpose of further improving the bus iness environment. The regulation specifies the principles for fostering a stable， fair，transparent and predictable business environment. What do you think of the current business environment and market perspective in China?

罗灿：我们很高兴能在第二届进博会开幕式上听到习近平主席的主旨演讲，特别是关于中国市场的进一步加大开放、放宽市场准入、改善营商环境及加强知识产权保护等方面的信息，让我们备受鼓舞。

我们十分感谢中国政府为建设良好营商环境所做出的不懈努力，这也为乐高集团将“寓教于乐”理念带给更多中国孩子提供了契机。

中国是乐高集团重要的战略发展市场。习主席的发言进一步加强了我们对中国市场以及未来在中国发展业务的信心。我们将继续投资于中国，将富有创意的乐高玩乐体验带给更多的中国儿童，帮助他们通过玩乐来学习和发展。

Robin Lynne Smith:President Xi had a keynote speech at the opening of the 2nd CIIE，and we welcome his speech，in particular his clear message that China will continue to open up its market， keep expanding its market access， continue improving business environment and strengthen IPR protection.

Weappreciate Chinese authorities' efforts in providing a favourable business environment，as well as the opportunity to operate in China and bring Learning through Play to more children.

China is a strategic growth market for the LEGO Group， and President Xi's speech further strengthens our confidence in China and the future of our business in the country. We will continue to invest in China to bring creative LEGO play and high-quality learning through play experiences to many more Chinese children.

“感激中国政府对优化营商环境所做的不懈努力”

《法人》：中国政府非常重视对外商投资的保护。《中华人民共和国外商投资法》也将于2020年1月1日起正式施行。您对这部新出台的法规有哪些重点关注的内容以及建议？

Faren Magazine:China attaches great importance to the protection of foreign investment. Foreign Investment Law of the People's Republic of China will come into effect since January 1st， 2020. As the General Counsel， what are your key focus on this law? And do you have any suggestions on it?

罗灿：作为一家外商投资企业，我们十分感谢中国政府为建设良好营商环境以及知识产权保护方面所做的努力。在过去一年间，我们欣喜地见证了政府多个部门为我们不断提供业务增长契机，我们也特别感谢上海警方在“乐拼”一案中的公正执法。上述种种举措，都为在华外商投资企业营造了可持续发展的理想营商环境。

Robin Lynne Smith:Weappreciate the Chinese authorities' many efforts in creating a favourable business environment for foreign companies， and we are grateful for the continued focus on intellectual property protection and enforcement by them.

Over the past year， we have definitely seen increased efforts from many different government authorities to provide new opportunities for business growth， and we are certainly grateful for the efforts of Shanghai Police in the Lepin raid action. It is important for this work to continue in order to further develop a successful and sustainable business environment for all companies operating in China.
